I'm surprised at how many scholars are jumping through hypothetical
hoops to protect the "copyright" of a reproduction of a text that is ( I
assume) in public domain.

I say "don't ask, don't tell." Stop looking for reasons to get
permission--which also means pay a fee--and simply put the material into
play under fair use guidelines.

We have to be more assertive in the protection of OUR fair use rights.
"Fair use," use it or lose it.
